Snehalaya Muktivahini rescues a girl trafficked from Bangladesh

Ahmednagar 24 November

Snehalaya's Muktivahini has rescued a girl brought from Bangladesh for prostitution.   There is still a long way before we reach rehabilitation and repartition.   But it has created a lot of awareness about trafficking among Police Department, Media, Judiciary and Civil Society in the Ahmednagar region.

“The Traffickers threatened to sell my kidneys when I refused to entertain the customers,” said Haseena (name changed), a trafficked victim to whom Snehalaya rescued from Flesh Trade on 25th October 2010. Snehalaya has contacted Haseena's family members who were  shocked to know what happened to her daughter after marriage , but expressed relief that their daughter is in safe custody of Snehalaya.

Haseena got married at the age of 14 years only. She was forced by her husband and others traffickers to enter India on the pretext of finding a job in Kolkatta. They traffickers  paid Rs.500to authorities of Border Security Force (B.S.F.) for crossing the border between Bangladesh & India. After a short stay at Kolkata, they sold her to the flesh market of Mumbai.  Some thugs and brothel keeper beat up the couple and separated Haseena from her husband.

Sharda Gaikwad, a brothel keeper from Ahmednagar purchased Haseena for Rs 25,000 from Mumbai. Sharda took her to  Parbhani for 3 days where Haseena was raped by more than 3 dozen people in private lodge. Once when she opposed and refused the demand of customers,   Sharda cracked a bottles of Beer on her head which caused the serious injuries.

Then Sharda brought Haseena to Ahmednagar district on October 6 after a lot of  physical &  mental harassment at Parbhani. Sharda stopped her Max Jeep vehicle (MH-23 C-952) at Hotel Tiranga near Newasa Phata, 52 km away from Ahmednagar. Some sensible local youth's saw Haseena crying in a closed and locked vehicle. They tried to ask about the reason but she was not able to speak in Marathi.  Haseena can speak a Bengali language only.  Hence she could not convey her story and inhuman pains.
They got a doubt and acted immediately.  They first informed Snehalaya and then the local police station.  Snehalaya’s team of Muktivahini quickly acted and rescued Haseena with the help of Police Inspector Mr.Kailas Gavde and his co-workers. Police arrested Sharda who allegedly trafficked Haseena from Mumbai to Ahmednagar. Other 2 traffickers  ran away from the place of incidence due to the darkness.

Sharda has accepted the committed crime and has reveled the names of other 2 accused namely Mansur Inamdar (Parbhani) and Babu (surname not known) of Mumbai who worked  with her in this act. Police hace registered a crime under sections 363, 366-B, 34, Section 3, 4, 7 of 1956 P.I.T.A. Act &; under section 376 of I.P.C. Police also registered a crime on Haseena also under Foreign Citizen Act 1946.

Haseena told about her suffering and humiliation to other bengali women sheltered in Shenalaya. We have assured her about security, safety and repatriation and have given professional counseling.  Our volunteer Advocate Sandip Vandhekar is providing all require legal aid to her at no cost. The crime under Foreign Citizen Act 1946 registered for the first time in Ahmednagar district.  Therefore there was lot of legal difficulties we faced.

She is not sure whether her husband was involved in her trafficking or not.  She is taking interest in cooking and tailoring at Snehalaya.  Many girls like Haseena are sold and used today in our country. Muktivahini expects active role of civil society in stopping domestic and international trafficking for flesh trade.  Sandeep Kusalkar, Hanif Shaikh, Kundan Pathare, Dattatray Panchal, Anita Mokate, Palavi Raskar, Manish Kasar, Shahid Shaikh, Alim Pathan, Ambadas Chavan, Anil Gawade, Gaurav klae, Amol Temghare, Sarikha Makode, Mina Shinde have played a major role in changing Haseena's life

Snehalaya's Muktiwahini rescued two minors (July 2008)

Ahmednagar
Date: 20th, July 2008 (Ahmednagar)

Rupa (14 yrs) and Asha (15 yrs)  (name changed) were rescued from the flesh trade from Hotel Bholenath, the road-side Dhaba at Nagar-Pune Rd. on 20th, July 2008.  The information was received from the Peer Educator of Snehjyot Project, that a woman named Sarswati Chougule has brought two minor girls at Hotel Bholenath Dhaba and Sarswati and the owner Sandip Kardile is pressurizing them to entertain the customers.

Our Muktiwahini team arranged the bogus customer to the Hotel Bholenath and confirmed the information.  Then the remaining team members went to the room where Rupa and Asha were kept and rescued them.  Both the girls were directly brought to Nagar Taluka Police station at night.  The Police was not ready to lodge the complaint as they didn’t know the clauses to be applied in these type cases.

Rupa is from very poor family of West Bengal and she was living with her aunt, Aunt was very cruel and used to bite her for any reason. Rupa was always scared.  So she was working in her aunt's home as a servant. A boy living near her house proposed to marry. At age of 13 Rupa ran away with the boy and came to Mumbai with him. Her husband sold her to one of the brothel owner called Amma(real name not known).

Amma forced her into the prostitution, after a few days Rupa ran away from the brothel Kamathipura, Mumbai too and came to Ahmednagar.  She met Sarswati on old bus stand, Ahmednagar.  Sarswati brought her to her house and tried to convince her to go to the Hotel Bholenath Dhaba for prostitution with her. She denied again but Sarswati forced her.

In the other case Asha is also very poor family from Solapur, her father is no more, she has two younger brothers and her mother is a bedridden patient so can not earn for daily needs.  Inevitably Asha has to earn, she started working as a construction labour.  One day she was raped by goons but she could not fight for justice. She came to Ahmednagar in search of job and was picked up by brothel owner Sarswati.

On 18th July 2008 Muktiwahini rescued them and produced before the Police Inspector Mr. Pardeshi.  He immediately ordered for her medical check up in Civil Hospital.  Next day she was taken to Child Welfare Committee and as per their order both the girls admitted in observation home.  The Dy. Muktiwahini (Anti trafficking team of Snehalaya) was keeping a close eye on Deepa allies Neelam Mithun Mahale age 40 who was supplying the minor girls to the customers.  Deepa was staying in Gajanan Colony, Wadgaon Gupta suburban of Ahmednagar.  Muktiwahini received information that Deepa had brought a minor girl in her house and invited some customers.  The Muktiwahini and Childline team tried to inform JAPU (Juvenile Aid Protection Unit) about the commercial sexual abuse of the child.  But no one was available from the JAPU unit.  Later Deepa came to Bhagat galli red light area and offered a minor girl to waiting customers.  Again Childline and Muktiwahini tried to get the help from Police.  After two hour Deepa received hint that she along with a minor girl will be trapped. Then Deepa tried to ran away from the brothel along with the minor.  At this moment Snehalaya’s volunteers in red light areas (Mukta team) informed about Deepa’s plan of escaping, Childline and Muktiwahini team rushed in the brothel, caught the brothel keeper and brought her to Kotwali Police station.

Police was forcing our team members for being the complainants. But we have taken a stand that we are the informers and want to become witnesses in the case.  But complainant should be the Police only.  It took seven hours to convince the Police.  Ultimately Police made the minor girl complainant and then the discussion started on what clauses of IPC and ITPA can be applied.  Our team has shown the guidelines by Hon. Mumbai High Court and Human Rights Commission regarding the law enforcement.  But it takes more two hours to convince.  Then the girl was sent for medical examination at  4 a.m. on 12th Feb. 2008 in govt. hospital.  After 34 hours from the incident the minor girl was examined.  Our team was providing continuous protection and emotional support to minor along with the ladies Police Constable.  Deepa was given to Police custody for 5 days by Session Court.  The girl was admitted in Govt. Ultimately the girl was kept in Snehalaya's rehabilitation center in Ahmedagnar. She was counseled properly along with her parents.  Now the family is well aware of the fact that what will happen if the girl blindly goes away with a criminal minded person with whom she has a one sided love.  Her parents also assured to pay attention  towards her.  Now Snehalya will regularly keep a contact with the victims family.

Minor from Sangamner recovered in Kolkata, the traffickers arrested (Sep 2005)

Ahmednagar : 29/9/05

A minor trafficked for the flesh trade from the nomadic tribe community of Ghulewadi ( Tehsil Sangamner ) was ultimately found in the red light area of Kolkata.  The Police officials of Ahmednagar district, with the help of Kolkata Police raided the brothel on Sharoni road and Sonagachi red light area and arrested the traffickers and the victim yesterday.  This is the inspiring success story of  the Muktiwahini of the Snehalaya.  A Complain was registered on Sept. 7, by Muktiwahini in this regard  The Trafficker Babita Mancharekar sold the girl to Kolkata based brothel keeper Ravindra Sing.  Ravindar sing is reunning the brothels in various parts in kolkata including Sonagachi and infamous for supplying of minors.  Police traced  Babita and Ravindra sing in Mumbai based brothel of Babita.  But the information received that they went to Kolkata from Mumbai by airplane with victim.
P.S.I. Mr. Vijay Shinde along with the group of 5 police went to Kolkata.  With the help of the Telecom Department they have traced Ravindra sing  and Babita in Kolkata and raided with the help of Kolkata Police.   They were brought in front of the court in Kolkata yesterday and permitted to transfer traffickers and victim to Ahmednagar District for further investigation.

Some of the Kolkata based organizations working in red light areas claims that there are no minors in the flesh trade or in the so called sex work, but now the evidence proves the reality. The Muktiwahini today congratulated Mr. Sanjay Patil, the Dy. S.P. for speedy investigation with proper approach.  Snehalaya also assured the total rehabilitation of the victim and her family in future.

In the second major achievement, a 12 years minor girl, trafficked from West Bengal and rescued by Muktiwahini on 4th, Sept. at Ahmednagar was sheltered in 'Sukanya,' one of the good quality shelter home of the W.B. Govt. on 25th Sept.  You might have remembere the Snehalaya Vrutta regarding Asana's case sent on 6th, Sept. The SANLAP, the local NGO's of Kolkata  has taken the responsibility of  her home study.
The main intention of sending the the minor victim to Kolkata is to create an awareness  among the  NGO's, social workers, the members of the child welfare committee of Kolkata.  The CWC has recorded the witness of Asana and ordered on the matter according to the Juvenile Justice Act 2000.  It  happened for the first time in the  last 12 years only because of the help and follow up of Mr. Vinayak Lohani, the Founder of Parivaar Kendra, his collogue Mr. Nimai Saha and Mr. Mamoon Akhtar, the founder of Samaritan Help Mission.  The volunteers of Muktiwahini stayed at their institutions. The co ordination between the organisations working in different states with the same goal is a creation of our honorary advisor  Shri. Rameshbhai Kacholiya .  This is the new beginning creating new hope in the life of innocent victims.

These institutions ( Snehalaya, Parivaar, SHM ) are getting any funds for  the anti trafficking and rehabilitation programmes. But running these activities with the help of society and the like minded donors. A timely help saved a life

A bengali girl is rescued from goons - Sep 2005

The Mukti wahini of the Snehalaya received an information on 4th, Sept. 05 that a minor  girl from some other state was trafficked to  Ahmednagar. A gang of goons was doing sexual abuse to a minor, she was also seen in some  of the infamous lodges where the flesh trade is going on.  The members of Muktiwahini  chased the girl and finally caught her on 6th,Sept. at 11.30 am. near central bus stand  of  Ahmednagar.  The traffickers and pimps ran away when Muktiwahini challenged them after  catching the girl.  The girl was very much  afraid at that time. We  have taken the help of Bengali prostitute Seema to know more  about Asana.

Seema told the story of Asana.  Asana was brought to Ahmednagar by  her so called maternal aunt for the better  opportunity of learning and job, but finally she has handed over to local pimps, who are   regularly supplying the minors for the flesh  trade.  Asana was sent to Snehalaya's shelter  home after her medical check up.

Legal Status of the case :

No case have been register in the local Police station for  following reasons.

1.    At the time of rescue the Police force was not available and hence not used by Muktiwahini.  Muktiwahini prefers to work with police and allied systems but most of the time police is are busy in different types of Bandobast.  The traffickers and pimps are also having good relation with police for the known reasons.
2.    The wastage of time : gives the opportunity to traffickers to run away with victim, hence immediate action has been taken by Muktiwahini team without waiting for police help.

3.    The mother tongue of girl is Bengali and there is no facility of leaning through Bengali language.  Hence keeping the girl in local govt. or private shelter homes may  harm her educational development.

4.    The police, Women and child welfare Department or the local CWC have no infrastructure, promptness and will to work on the issue of minor's rescue, repatriation and rehabilitation.  Considering the over all condition of the girl we have  handled the issue with our own way.

5.    In the present system, the victims of commercial sexual exploitation, trafficking and rape have to face defamation, loss of time, money and life.  The arrested criminal stays in prison with all comforts.  The victim has to attain the court with his own cost and responsibility for many years.  Finally the victim never get any compassion  whether the crime is proved or not.  We believe and work in sensitization of the system and the society on this issue.

But at the same time we think that the minor victims should not be punished for no reason and the process of  their overall development must be immediately started.  In the legal matters it is also seen that victim has to remember all the incidents, persons for a long time for the unending  judicial process. The continuous protection of the victim also becomes major problem.

We expect that

1.    The home study of Asana should be done carefully by the NGO, based in Kolkata.
2.    The decision of her repatriation or rehabilitation in any shelter home should be based on the home study report.
3.    Mr. Mamoon Akhtar, the social worker and the founder of SHM and Mr. Vinayak Lohani from Parivaar centre will participate in the process of  Asana's rehabilitation on behalf of Snehalaya.  And he will work as a bridge between Snehalaya and the NGO's in WB handling this issue.
4.    A system of stopping the trafficking effectively and repatriation / rehabilitation should be develop in  W.B.  Hence the issue must be put in front of  State Govt. and NGOs properly.  There are hundreds of major and minor victims we find in Ahmednagar district and all the red light areas in  Maharashtra.  And the question is not limited for Asana only.  But we have taken it as an opportunity to convey the horrifying reality of the trafficking from W.B.

A minor sold by her parents, gets back her family (Sep 2005)

Ahmednagar , 14th, Sept.

A minor was sold for flesh trade by her own parents and this serious crime was brought to notice of the Sangamner Police by Muktiwahini of Snehalaya yesterday. Badshaha Nacharekar, the father and ten others were arrested by Police.  Police troop went to Mumbai  to arrest the traffickers and to rescue the minor.

Ghulewadi is the village on Nashik Road 7 Km away from Sangamner.  About 40 families of nomadic tribes have settled  here mainly the Kanzarbhat community normally most of the families of this community are illiterate and producing the country liquor.  Badshaha Nacharekar belongs to this community.  Due to financial crunch, Badshah decided to sale his 14 years daughter to Babita. Babita was the resident of Sangamner but now a days staying in Mumbai in a posh locality.  She has her bungalow and  supplying the girls to brothels, hotels and dance bars.  Babita was constantly in touch with the poor nomadic tribe community.  Two months ago he has brought two minors from Ghulewadi's nomadic tribes families.  She gave handsome amount to the traffickers.

The parents were told that their girls were admitted to hostels  for education.  This story  has also came in lime light when some of the arrested criminals opened their mouths, due to Police tricks.  Badshaha, his wife Salma and brother went to Mumbai on 1st Sept.  Babita was waiting for them in a lodge near Mumbai Central.  Later they handed over their daughter to Babita and took Rs. two lakhs in cash.  Mr. Rajesh Pawar a local Jeep driver was with them in their tour to Mumbai.  While returning form Mumbai Rajesh heard the dialogue of Nacharekar family in their nomadic tribe language about the deal.  Salama was cursing Badshaha for taking only two lakh rupees instead of three lakhs fortunately Rajesh was knowing their language.  After returning from Sangamner he told the incident to some of his friends who cautiously conveyed  to Muktiwahini about the whole incident of the trafficking.  After enquiring  through private sources the information was given to  Sangamner Police.  Mr. Sanjay Patil, the Dy. Police chief of the Sangamner region arrested Badshaha and ten others involved in the crime.  Case was registered under the Prevention of Immoral Trafficking Act 1986 as demanded by Muktiwahini.  Now the Muktiwahini is perusing the arrest of Babita and rescue of the minor by a Police troop from Mumbai.

Muktiwahini Members asked Badshaha, why he sold his daughter ? He said that he has taken a huge loan from a private money lender by  huge interest and he has to repay Rs. three lakhs immediately.  He claimed that he has not sold his daughter in greed of money, but to save the life of all other the family members from the money lender.

Snehalaya's Muktiwahini rescued two minors (July 2008)

Date: 20th, July 2008 (Ahmednagar)

Rupa (14 yrs) and Asha (15 yrs) allies Yasmin (name changed) rescued from the flesh trade from Hotel Bholenath, the road-side Dhaba at Nagar-Pune Rd. on 20th, July 2008.  The information was received from the Peer Educator or Snehjyot Project, that a woman named Sarswati Chougule has brought two minor girls
at Hotel Bholenath Dhaba and Sarswati and the owner Sandip Kardile is pressurizing them to entertain the customers.

Our Muktiwahini team arranged the bogus customer to the Hotel Bholenath and confirmed the information.  Then the remaining team members went to the room where Rupa and Asha were kept and rescued them.  Both the girls directly brought to Nagar Taluka Police station at night.  The Police was not ready to lodge
the complaint as they didn’t know the clauses to be applied in these type cases.  Rupa is from very poor family of West Bengal and she was living with her aunt, Aunt was very cruel and used to bite her for any reason. Rupa was always scared.  So she was working in her aunt's home as a servant. A boy living near her house proposed to marry. At age of 13th Rupa ran away with the boy and came to Mumbai with him.

In the other case Asha allies Yasmin is also very poor Muslim family from Solapur, her father has no more, she has two younger brothers and her mother is a bedridden patient so can not earn for daily needs.  Inevitably Asha has earn hence, she started working as a construction labour.  One day she was raped by goons but could not fight for justice. She came to Ahmednagar in search of job and reached to the brothel by Sarswati. The Dy. S.P., Mr. Sandip Doiphode ordered to arrest the guilty.
